Landlord and Tenant

Celeste wrote on 5/11/2006 12:28:29 PM :

I got to noticing that there is nothing in this Province for tenants. Landlords seem to have most of the rights. Or the laws seem to favor the landlord rather than the tenant. At least that is the way it appears. What tenants need to do is to form a Advocacy Group. One that seek legislation or legislative amendments to a Tenant Protection Act to ensure justice for tenants who are seeking fair treatment. Very often they (tenants) have no where to turn, and ultimately winds up being homeless. Not necessarily living on the streets per sa, but "less home".

Let me paint a couple of scenarios for you,

What if you find yourself in a dispute with your fellow tenant and are unable to resolve it yourselves, where do you go if your landlord does not assist you in resolving the issue? What if you are afraid for your safety. Who can help you? What if your Landlord is the problem? What if your landlord has attacked or threatened you with bodily harm,  of course you should first call the police, but  after the situation has been brought under control what do you do next?

lots of what "if" right, but it is happening and what is a person to do?

Lets open this dialogue to see what we can come up with.

Having been both tenant & landlord;  Being a tenant has never been a problem for me nor my own landlord.. maybe I was lucky but I also treated the place like it was my own.. "with respect".

On the other hand.. the losers that I've had as tenants where I as a landlord was affraid to kick them out of fear they would ramsack the place worst then what they had already done.

One of them, one of my last, they were always fighting; the doors were banging and they would scream at the top of their lungs at the kids. I still remember one of them screaming.. I'm not your father! Then, I heard the mother talking on the phone with someone and fighting over if her kids had ate that day or not.

Anyway, I taught there was alot of trafic and I hated it but I figured it was none of my business.. they didn't drive so, oh well. I was down stairs one day washing some clothes when I heard the door bell ringgin. Then I heard them tell however to wait that they would get the "scale".. Well! Dahh, that's when I figured it out.

So, after a few drinks and a few people over who had given me the strenght to give them their notice in writting; one of them even come with me for a witness haha.. they refused to leave and pay. I was stuck with those losers plus, nothing I could do to throw them out until the 21st of that month. After which the sherrif was coming to get them out. Oh, a little detail I forgot, he had even treatened to shoot me and I was still stuck with them.

So, all this to say in my own experience; usually the good tenants don't get bottered. The bad one's deserve worst than what the rules are now. If they put a treat against their tenant.. the tenant in turn, if they want to press charges (which I was affraid to), they can get them removed that day I believe; from their own home.

Did you go to the police for help?
SoulsBreath wrote on 5/12/2006 6:33:23 PM :

Yes, I did. When he treatened my life; two cops come over for a statement.. they advised me not to press charges and unless I did, there was nothing they could do.

They had records on him already...when he finally left I heard he got busted and was in Jail.

They "looked" like a nice couple when they came to rent the place haha..

I disagree with you NBwicker. I think when you are tenant and you have very little to say landlords have all the power and if you don't like it move out. Well who the hell wants to move once a month just because you have a bully for a landlord.

In my opinion, if you rent on a month to month lease; that's the chance your gonna have to take once you get kicked out; and same goes for the landlord when the tenants decide to leave.

On a yearly lease, now that's a different story; a landlord can't kick you out until the end of lease unless he's got a darn good reason and the rentalsman would decide on that so... what's good for the goose is good for the gander. Big Smile [:D]

Landlords and tennants are a two way street. You have good landlords and bad ones just as you have good tennants and bad tennants. Finding the right match is tough but ultimately, the landlord owns the location. Its like parents and there teenage kids. You don't like it...get out. Doesn't mean the landlord is right.

As a landlord so far I've been screwed out of 400$ rent. Had a carpet cleaned for fleas that where no existand. Let someone paint her room pink and she moved out a month later. Had them bust open a bedroom door that had a lock on it when I told them they shouldn't have a lock on it. That's just off the top of my head in this past year. Not to mention paying to have the driveway cleaned over the winter but the tennants never removed there cars so most of the time it wasn't cleaned.

Bottom line if the landlord is really doing something that isn't right and in violation of the tennant, the rentalsman office will sort it out. If things get regulated and you fear the landlord is mad at you and will make your live tough then you're problem is not a landlord, your problem is a person with psychological issues!

this was posted a while ago but Here's what I have to say in regards to it. The landlord is the OWNER of the location. He has paid money to purchase this location. Granted no one deserves a landlord who threatens and treats his tennants like crap. I try to be very nice to my tennants and accomodating and you know what that gets me? I get walked all over pretty much.

If you as a tennant contact the rentalsman office (and that's what they're there for, to mediate) they or very often accomodating to tennants. If you feel uncomfortable after the resolve of the situation and feel you're beeing treated badly by the landlord you have two options. 1 go back to the rentalsman office which will probably make the situation worse or 2 move out, get a new place.

Its shitty to say but you are living in his property. If you don't like things, yea, you can try to change things, but chances are it won't work in your favor. I do think that a landlord should be accomodating and a genuine good guy, but unfortunately not all are...just as MANY tennants aren't Ideal and have no respect for the property they are renting or the person they're renting from.
