    SAINT JOHN - The Crown has begun the process to have Philip Joseph Dalton Penny declared a dangerous offender.

    It is a very rare step that requires prior approval from the Attorney General, which has been granted in this case.

    If successful, Penny would become only the seventh person in New Brunswick to ever receive the designation and be sentenced to an indefinite period in prison.

    Penny, 36, was found guilty in May of aggravated assault for beating up his former girlfriend and breaking her jaw.

    He was scheduled to be sentenced on Friday, but Crown prosecutor Catherine McNally requested he be remanded for 60 days for a psychiatric assessment, under the dangerous offender provisions of the Criminal Code.

    The assessment would be used to decide whether to proceed with the application, which would require a hearing, said McNally, as Penny sat in the prisoner's box, staring intermittently at the ceiling and floor.

    The dangerous offender provisions of the Criminal Code are intended to protect Canadians from the most dangerous violent and sexual predators in the country.

    When someone is declared a dangerous offender, he or she is sentenced to an indefinite period in prison and released only when regular reviews determine that the risk of future violent or sexual offences no longer exists. So he or she could potentially be incarcerated for a much longer period than the maximum sentence provided under the Criminal Code for that conviction.

    The maximum sentence for aggravated assault is 14 years in prison.

    Penny, who goes by the name Joe, has a lengthy criminal record, dating back almost 20 years, including two previous convictions for aggravated assault. He has been in prison four times, serving the past two sentences right up until his warrant expiry date because he refused to take any programs.

    On Dec. 14, shortly before 11 p.m., Penny punched a woman who was then his girlfriend an estimated seven times in the face. The 23-year-old woman's jaw was severely broken on both sides, requiring reconstructive surgery, a metal plate and wires. She also had hand-shaped bruise marks around her neck and bruising across her chest and down one arm.

    There's still no sign of a pair of eight-week old Pomeranian puppies stolen from a Moncton pet store Tuesday afternoon.

    There's a possibility the couple behind Tuesday's dog-napping may have visited another Mountain Road pet store earlier in the afternoon. Staff at Pets Unlimited in the Northwest Centre believe a teenaged girl with a male companion in their store Tuesday afternoon matched the descriptions of those who ran out of Brenda's Bowtique with the two puppies just after 3 p.m. the same day.

    The couple at Pets Unlimited was not in the store long, and if they were the same people behind the theft down the street, it may be because of the different pens at each store.

     

    Anyone with any information about the incident should call the Codiac Regional RCMP at (506) 857-2400 or Crime Stoppers at 1-800-222- TIPS(8477).

    Codiac RCMP are attempting to link a series of spray-painted messages, including swastikas and racist declarations, at five different Moncton locations during the last 48 hours.

    Two large swastikas and racist messages were spray-painted on the side of Moncton's two-year-old mosque on High Street. One swastika was painted in black, while the other and the message were painted in red.

    Other offensive messages were found during the last two days at the Tiferes Israel Synagogue on Steadman Street, the Mapleton Road Shell station and Beaverbrook School and St. Hubert restaurant, both on Mountain Road.

    Moncton is home to between 200 and 400 Muslims. They spent more than $400,000 two years ago to refurbish the former Foresters' Hall and build the mosque, which is open every day for prayers.

    Another dog has been stolen in Metro.
     
    A three-year-old Pug mix is missing from the Moncton SPCA. Employees say the last time Archie was seen with the other dogs was 3 p.m. on Sunday afternoon. When they went to bring the pups back in, Archie was nowhere to be found.
    The dog had only been given up for adoption by his previous owners on Friday. Pearl says she has no idea who would want to steal a dog from them and she's concerned for the helpless animal's health.
    The dog is striped beige and brown making him "brindle" in colour. Pearl says that he is not a purebred pug, but to look at him it is very obvious that he is a mix of a pug and something less prominent, perhaps a Boston Terrier.

    OTTAWA - Officials with Corrections Canada are contemplating a prison transfer for New Brunswick's most notorious serial killer from a special-handling unit that houses Canada's most dangerous offenders to the segregation unit or general population at a less secure prison, according to a source close to the decision.

    Sources told the Times & Transcript that Allan Legere is scheduled to be transferred next week from the super-maximum security Special Handling Unit at Ste.-Anne-des-Plaines near Montreal to a regular maximum security prison in Port-Cartier, 70 kilometres west of Sept-Iles, Quebec.

    Allan Legere is serving a life sentence for the grisly murders of five people in the Miramichi area between 1986 and 1989.

    "Legere is excellent at manipulating other people," said Vincent Poissonnier, head of RCMP major crimes unit during Leger's murder spree.

    "If he applied for a transfer and if the transfer was authorized, he was obviously successful at conning those who authorized the transfer. Under no circumstances should his security level be lowered."

    "His only quest is to escape. He has scores to settle and given the opportunity, he will."

    Legere was sentenced to life in prison for the 1986 murder of John Glendenning, a shopkeeper in Black River Bridge. His wife Mary was badly injured during the home invasion.

    Two years later, Legere injured himself deliberately while in custody at the maximum security penitentiary in Renous.

    He was transported to the Dr. Georges-L. Dumont Regional Hospital, where he orchestrated a daring escape.

    Legere managed to convince two guards to let him use the washroom alone.

    There, he picked the lock on his handcuffs with a piece of car antenna he concealed in his body.

    He used the antennae to fool the guards into thinking he had a homemade knife, escaping by forcing a driver to take him to a wooded area near Moncton's industrial park.

    The terror in Miramichi started three weeks later when firefighters arrived at the home of a pair of elderly cousins.

    Inside they found a badly beaten Nina Flam sitting at the foot of the stairs.

    Her cousin Annie Flam, in her late 70s, was found beaten to death upstairs. She had been sexually assaulted.

    Four months later firefighters were again called to a burning house where they found the bodies of sisters Linda and Donna Daughney.

    One month later, police found the body of Father James Smith, 69, beaten in his home in Chatham Head.

    The manhunt came to an end in November 1989 when Legere surrendered to police near Nelson.

    This wouldn't be the first time Corrections Canada contemplated moving Legere from the extra-secure unit where he has spent the past 17 years. Federal corrections officials authorized a transfer from the prison in Ste.-Anne-des-Plaines in 2000 but changed their minds after mounting political pressure.

    TORONTO  —  A police officer at the scene of a grisly beheading on a Canadian bus reported seeing the attacker hacking off pieces of the victim's body and eating them, according to a police tape leaked on the Internet Saturday.

    In the tape of radio transmissions, a Royal Canadian Mounted Police officer refers to the attacker as "Badger" and says he is armed with a knife and scissors and is "defiling the body at the front of the bus as we speak."

    On the tape, which lasts about 80 seconds, officers continue to detail the attacker's movements until one reports, "Badger's at the back of the bus, hacking off pieces and eating it."

    A recording of radio transmissions made by RCMP officers responding to the murder on a Greyhound bus near Portage la Prairie has been leaked on the Internet.

    The police communications discuss the situation aboard the bus after it was pulled over and the suspect was locked inside with the victim on Wednesday evening.

    "The radio transmissions in question are operational police communications and, as such, are not meant for public consumption," RCMP in Portage la Prairie, Man., said in a statement. Police have not said how the audio recording, which was posted online by LiveLeak.com, was obtained.

    Readers should note that the following transcript contains graphic material:

    - Alpha Eight, Zulu. Yeah, be advised they're using the car in the ditch right beside the (bus) as a command post here. I got Delta One and Alpha Four's just getting geared up.

    Vince Li, the 40-year-old Edmonton man who killed, beheaded and ate the flesh  of 22-year-old Winnipegger Tim McLean aboard a Greyhound bus Wednesday, is on suicide watch at the Winnipeg Remand Centre.

    When asked if he was suicidal, Li is said to have nodded ‘yes.’

    Sources said Li is to be watched by a minimum of five correctional officers if he needs to be transported from his cell. He is also to have his handcuffs and shackles thoroughly checked, as it’s believed he’s a flight risk.

    A passenger repeatedly stabbed and then decapitated another person aboard a Greyhound bus travelling through Manitoba overnight, a witness said Thursday.

    Australian police seize 15 million ecstasy pills in world's largest haul

     SYDNEY - An international drugs and money laundering syndicate has been smashed by a joint European and Australian police operation following the world's largest single seizure of ecstasy with a street value of $A440 million.  The investigation was triggered by the discovery of 15 million pills of ecstasy in Melbourne in June last year.  The drugs had been imported from Italy, and were hidden inside more than 3000 tomato tins stored in a shipping container.
